New Regulations in the Health Services Sector
The Regulation Amending the Regulation on Private Healthcare Institutions Providing Outpatient Diagnosis and Treatment (Outpatient Diagnosis and Treatment Regulation) and the Regulation Amending the Regulation on Private Hospitals (Private Hospitals Regulation) entered into force through its publication in the Official Gazette dated 07.01.2023 and numbered 32066. The main novelties brought by the Regulation are summarized below.
- Pursuant to the amendments made to the Outpatient Diagnosis and Treatment Regulation and the Private Hospitals Regulation, doctors may diagnose and treat their patients who apply to their clinics in medical centers or private hospitals that have a license in the relevant branch, provided that an annual contract is concluded.
- Medical centers or private hospitals may sign a contract with doctors up to one-third of the total number of doctors in the relevant branch. However, doctors over the age of 60 who have a practice are not subject to this limitation in one of the medical centers or private hospitals they contract. Doctors who had a practice before 07.01.2023, are exempted from the limitation in one of the medical centers or private hospitals they contract.
- In cases where the medical intervention cannot be performed, a case-based special permission may be granted by the provincial health directorate to perform this procedure in another medical center or private hospital requested by the doctor.
- Medical centers providing services within this scope must submit the contracts executed with the doctors to the provincial health directorate. On the other hand, private hospitals should add the contracts executed with the doctors to the Private Health Institutions Management System (PHIMS) and submit them then to the health directorate.
- Additionally, the regulation that suspends the right to sign contracts with doctors up to 15% of the number of staff in specialist doctor branches registered in the licenses and/or operating permit of medical centers and private hospitals for 1 year has been repealed.
