Amendments to the Legislation on Private Hospitals and Private Health Institutions
The Regulation Amending the Regulation on Private Hospitals (Regulation on Private Hospitals) and the Regulation Amending the Regulation on Private Health Institutions for Outpatient Diagnosis and Treatment (Regulation on Private Health Institutions) namely (Amending Regulations) entered into force through publication in the Official Gazette dated 07.04.2023 and numbered 32156. The amendments made by the Amending Regulations are summarized below:
- The deadline for private hospitals, which were licensed before 07.04.2023 or whose preliminary permission and licensing procedures are ongoing, to bring their bed numbers in line with the Regulation on Private Hospitals has been changed from 31.12.2022 to 31.12.2024.
- Doctors who want to treat their patients that apply to their clinics, in private hospitals or medical centers by means of an annual contract, if there is no private health institution in the relevant branch in the province where the practice serves, may conclude that contract by taking the opinion of the relevant commissions established by the Ministry of Health in the nearest province.
- Private hospitals that received pre-authorization from the Ministry of Health before 01.01.2019 but failed to complete the licensing procedures at the end of the five-year licensing period were given an additional period until 31.12.2028 to complete the licensing procedures.
- With the Amending Regulations, doctors who established a clinic before 07.01.2023, are exempted from the staffing limitations in at most two of the clinics and/or private hospitals they will contract with. It was stated that if these doctors close their clinics and reopen them in the same or different province within three months, their exemption will continue
