World Bank Workshop on EU Digital Regulations and Their Impact on Trade
As part of a series of concurrent projects and studies conducted by the Ministry of Trade to evaluate the impact of European Union (EU) digital regulations on Türkiye’s trade and investment relations, a workshop was held in collaboration with the World Bank on December 2-3, 2024, at the Ankara Hilton SA Hotel. The workshop focused on examining the effects of selected EU regulations on Türkiye’s trade relations. During the workshop, an engaging exchange of ideas took place through a series of insightful presentations. The sessions provided an in-depth exploration of the key topics, enhanced by the participants' insightful questions and comprehensive discussions.
Özgür Kocabaşoğlu, Erdem & Erdem Partner and Head of Corporate, and Sevgi Ünsal Özden, Erdem & Erdem Managing Associate and Mediator and Assist. Prof. Osman Gazi Güçlütürk from Galatasaray University Faculty of Law contributed to the workshop with their presentations, which was also attended by participants from Ministries and various administrations.
On the first day of the workshop, Dr Osman Gazi Güçlütürk delivered presentations on the Flow of Non-Personal Data and Protection of Trade Secrets, Data Act, Data Governance Act and the AI Act. With these presentations, Güçlütürk analysed the issue of data flow under the Customs Union Agreement, Data Act, Data Governance Act and the AI Act. On the second day of the workshop, he made presentations on Implications of the EU's Digital Services Act (DSA) and Digital Markets Act (DMA) on E-exports to the EU and Overview of the EU's Cybersecurity Framework and its Effects on Trade, respectively.
On Monday, December 2, Sevgi Ünsal Özden delivered a presentation titled "Regulation on Personal Data Flows" during the first panel of the workshop. In her presentation, Sevgi Ünsal Özden analyzed the current situation after the recent legislative amendments by addressing the main differences between the Turkish data protection legislation and the European Union data protection legislation and discussed the key steps to be taken for the full harmonization of Turkish and EU data protection legislation.
On Tuesday, December 3, Özgür Kocabaşoğlu delivered a presentation titled "Mapping of EU Consumer Protection Legislative" during the first session of the workshop. In his presentation, Özgür Kocabaşoğlu made an overview of the EU consumer protection legislative instruments related to e-commerce, and then made a presentation on the expected legislative changes in line with the EU's new consumer agenda, mechanisms for resolving consumer disputes in e-commerce, sustainability and the European Green Deal and green transformation issues, developments in the EU consumer rights, product safety and market surveillance.
In the second panel of the workshop, titled "Comparison of Pertinent Turkish Legislation and Acquis Communautaire," Özgür Kocabaşoğlu analyzed Türkiye’s consumer protection legislation in the field of e-commerce and discussed the main differences between the EU and Turkish legislation. In addition, after evaluating the current situation in the harmonization process, he addressed the problems that a consumer residing in the EU may face during an e-commerce service from Türkiye.
