The Law on the Amendment to the Consumer Protection Law and Certain Laws
Law No. 7529 on the Amendment to the Consumer Protection Law and Certain Laws (Law No. 7529) is published in the Official Gazette dated 30.10.2024 and numbered 32707.
The amendments made by Law No. 7529 to Law No. 6563 on the Regulation of Electronic Commerce (Law on E-Commerce) are summarized below:
- Certain exceptions and reductions are introduced in the calculation of license fees of electronic commerce intermediary service providers.
- The amendments made by Law No. 7529 to Consumer Protection Law No. 6502 (CPL) are summarized below:
- It is stipulated that consumer loan agreements and housing finance agreements may be concluded remotely. Furthermore, consumers are now able to communicate their request not to close their accounts regarding fixed-term loan agreements and housing finance agreements via permanent data storage devices.
- Before the amendment, the details regarding the direct sales system were regulated under the Regulation on Contracts Established Outside of the Workplace (Regulation) under Article 47 of the CPL. With Law No. 7529, the direct sales system is also defined within the CPL in parallel with the definition in the Regulation.
- The new legislation introduces an obligation for direct sales companies to operate as capital companies. Furthermore, the CPL highlights the consumer protection obligations that apply to these companies.
- It is stipulated that the consumer who purchases goods or services within the scope of the direct sales system has the right to withdraw from the contract within 30 days without any justification and without paying any penalty. This period was set as 14 days in the Regulation.
- Sanctions are introduced for those who violate the obligations regarding direct sales.
- Administrative fines for advertisers, advertising agencies, and media organizations that breach commercial advertising regulations are increased.
- The provision excluding administrative fines imposed by the Advertisement Board from conciliation requests is repealed.
- The provisions of Law No. 7529 on direct sales and sanctions will enter into force on 30.07.2025, and the other amendments made to the CPL have entered into force through publication.
