442 NEWSLETTER 2018 Important Legislation and Decisions regarding Competition • The Competition Board (“Board”) granted individual exemp- tion to the “Authorized Dealer Agreement” that is projected to be signed between Trakya Cam Sanayii A.Ş. and nineteen dealers as it satisfies all of the conditions under Article 5 of Law numbered 4054. (21.12.2017, 17-42/670-298) • The Board authorized the privatization transactions by way of granting operation rights of the Tekirdağ Port belonging to Türkiye Denizcilik İşletmeleri A.Ş. for thirty-six years. (08.02.2018, 18-04/61-35) • The Board granted negative clearance to the Financial Le- asing, Factoring and Financing Companies Union to obtain some data in the financial tables of the members regarding financial leasing, factoring and financing services markets, and the additional certain data from its members, periodi- cally, and to share certain data within the scope of the tran- saction that is sharing the earlier data with its members. The Board decided that sharing certain data, individually, may not obtain negative clearance or individual exemption, and a 5 year individual exemption shall be granted to the sharing of some data. (15.02.2018, 18-05/79-43) • The Board granted theAgreements onAuthorized Services of Light/Medium Commercial and Riding Vehicles concluded between Ford Otomotiv Sanayi ve Ticaret A.Ş. and Otokoç Otomotiv Ticaret ve Sanayi A.Ş., the group exemption under the Communiqué on the Group Exemption regarding the Vertical Agreements in the Motor Vehicles Sector numbered 2017/3. (08.03.2018, 18-07/118-64) • The Board decided that the “Tender Sales Agreement” concluded between Bayer Türk Kimya Sanayii Ltd. Şti. and Medifar Ecza Deposu İlaç Tic. A.Ş. benefits from the group exemption for products of which the market shares are below 40%, and granted individual exemption to the said Agree- ment considering the products of which the market shares are above 40%.
