455 LEGAL DEVELOPMENTS Important Legislation and Decisions regarding Competition • The Competition Board (“Board”) decided that the protocol signed between Tofaş Türk Otomobil Fabrikası A.Ş. and Peugeot S.A. regarding the supply of commercial vehicles by Tofaş Türk Otomobil Fabrikası A.Ş. to Peugeot S.A. for two years starting from 01.01.2016 cannot be negatively cleared; however, this protocol may be granted an individual exemption. (24.12.2015, 15-45/755-277) • The Board decided that “TEB-İDO Cooperation Agreement” signed between Türkiye Ekonomi Bankası A.Ş. and İstanbul Deniz Otobüsleri San. ve Tic. A.Ş. cannot benefit from group exemption; however, the Board granted an individual exemption to this agreement. (06.01.2016, 16-01/7-2) • The Board decided to grant an individual exemption to the “Agreement of Distribution” drafted in line with the amend- ment undertakings signed betweenArcelorMittal Flat Carbon Europe SA, Bamesa Çelik Servis Sanayi ve Ticaret A.Ş. and Bamesa Muradiye Çelik San. Tic. A.Ş., BAMİ Çelik Servis Sanayi ve Ticaret A.Ş., and grant an individual exemption to the “Memorandum of Understanding” signed between Ar- celorMittal Flat Carbon Europe SA, ArcelorMittal Tailored Blanks N.V., Bamesa Aceros, Bamesa Çelik Servis Sanayi ve Ticaret A.Ş. and BAMİ Çelik Servis Sanayi ve Ticaret A.Ş. (21.01.2016, 16-03/54-19) • The Board decided not to issue a certificate of negative clear- ance to the decision of Bankalararası Kart Merkezi A.Ş.’s Board of Directors dated 25.02.2015 and numbered 2015/4 regarding the foundation “Payment Method of Turkey – TROY,” but to grant an individual exemption; not to issue a certificate of negative clearance to the “Licence Agreement” for the foundation of the TROY system signed between Bankalararası Kart Merkezi A.Ş. and Discover Financial Services LLC, that it benefits from group exemption; and
